The discussion of the basis of this article is the first question that arises. Jurisprudence basis of Ta'zire sentences classification including the rule of "Al-Tazir Bma-i-e-Yad al-Hakim" and the Modeling the laws of Western countries, especially the United States of American is one of the issues that will be discussed about the basis of this article. This classification has many legal effects that we will study of these effects. Effects such as determining the jurisdiction of criminal courts, Determination of procedural procedures, determination of the consequences of convictions, prescription, determination of penalties in relation to the accessory, attempt and etc.  Also we will measure the effectiveness of this article in procedure and refer to some of its shortcomings, and finally we will present our corrective headings. Meanwhile, the method of research is analytical-descriptive and a library collection tool has been used. یکی از نوآوریهای قانون مجازات اسلامی 1392 که آثار مهمی را در حقوق کیفری اعم از حقوق کیفری ماهوی و حقوق کیفری شکلی به دنبال داشته است، درجه بندی تعزیرات بوده است. طبیعی است که این مقرره همانند هر پدیده جدیدی، علاوه بر محاسنی که به دنبال دارد در ابتدای راه با کاستیها و ایراداتی نیز رو به روست. ایراداتی ازجمله جامع و مانع نبودن درجات تعزیر، ابهام در تشخیص درجه برخی از جرائم، عدم ملاحظه عدالت قضایی در تعیین درجه برخی جرائم و نامتوازن بودن فواصل میان حداقل و حداکثر مجازاتهای داخل در یک درجه. در این مقاله به دنبال آن بودیم که ضمن بررسی تفصیلی ایرادات وارد بر نظام درجه بندی مجازاتها، پیشنهاداتی را برای رفع آنها ارائه کنیم. راهکارهای ارائه شده عبارتنداست از پیشنهاد احصای تمامی مصادیق تعزیر در ماده 19، خارج کردن مجازاتهای غیرتعزیری از شمول این ماده، اصلاح تبصره 2 ماده 19 و ... به عقیده ما نظام درجه بندی تعزیرات در مجموع به نفع نظام حقوق کیفری ایران بوده و از مشکلات آن کاسته است اما دارای ابهامات و ایراداتی است که مانع تحقق کامل اهداف مقنن شده است و لازم است در اصلاحیه های بعدی قانون مجازات اسلامی رفع گردد. در ضمن روش انجام این پژوهش، تحلیلی_توصیفی بوده و از ابزار گردآوری کتابخانه ای استفاده شده است. https://leg.isu.ac.ir/article_2805_e7a96652ba55d46e023d4aa380b4af79.pdf
