The possibility of legal system’s changing in every period, necessitates as a central concern in constitutional law the design of Constitution-making process desirably. Looking attentively to the effective and fundamental characteristics of this process indicates that ensuring maximum participation of people, the openness of responsible bodies’ proceedings and public awareness of them, hindrance of the interested individuals and parties in imposing the power, preventing the chaos and disorder in the country and also, ensuring the participation of elites and experts are as the most important elements in ideal designing of such process. However it’s impossible to suggest one similar pattern for all countries, but the substantial point is how countries can attain the Constitution-making desirably in a competent process; the theme this article is to answer with a descriptive- analytical approach. چارچوب و بنای اصلی هر دولت قانونمند با قانون اساسی ترسیم می‌شود و از همین روی، پیش‌بینی الزامات و سازوکارهای طراحی این قانون از اهمیتی غیر قابل انکار برخوردار بوده و از این منظر نیز ضرورت و فایده تبیین الگوی مطلوب تدوین و تصویب قانون اساسی آشکار می‌گردد. البته هرچند نمی‌توان در این رابطه، الگوی واحد و یکسانی را برای همه کشورها پیشنهاد نمود، اما مسئله اساسی آن است که کشورها چگونه می‌توانند در یک روند مطلوب و شایسته، به تدوین و تصویب قانون اساسی مبادرت ورزند؛ امری که این نوشتار با رویکردی توصیفی- تحلیلی درصدد پاسخ به آن می‌باشد و از همین رهگذر نیز، ارزیابی فرآیند مزبور در خصوص قانون اساسی جمهوری اسلامی ایران را مطمح نظر قرار می‌دهد. امعان نظر در مؤلفه‌های مؤثر و اساسی در این فرآیند مبین آن است که تضمین مشارکت حداکثری مردم، علنی بودن اقدامات نهادهای مسئول و آگاهی‌یافتن عموم از این اقدامات، جلوگیری از تحمیل قدرت از سوی افراد و گروه‌های ذی‌نفوذ، ممانعت از ایجاد آشوب و بی‌نظمی در کشور و همچنین تضمین مشارکت نخبگان و کارشناسان از جمله مهمترین‌ مؤلفه‌های فرآیند مطلوب در تدوین و تصویب قانون اساسی می‌باشند. https://leg.isu.ac.ir/article_2791_ad82140cafe816c41a9c9974e9240b7a.pdf
