Since the new regulations are in some cases lacking the legislative process, it naturally requires an analysis and study of the impact on the criminal law system, in addition to discovering the dimensions of the new developments, the ambiguities and deficiencies in the new legal material have also been discovered and in future amendments to the law Pay attention. In this research, it has been tried to infer and evaluate the legal and legal approach of the legislator by analyzing the foundations of the articles of the Penal Code adopted in 1370 and the articles of the Penal Code adopted in 2013 on Diat. The legislator seems to have focused on a special focus on the fatwa of Imam Khomeini in the 1991 law enacted to a combination of his fatwa, popular fatwa, and the fatwa of the Supreme Leader. Some of the changes have also been motivated by the unraveling of previous judicial problems, and some others have been taken into account by the Islamic Penal Code in the wake of the jurisprudence of the Guardian Council. کتاب دیات در قانون مجازات اسلامی ازجمله مباحثی است که به سبب خلأهای قانون 1370 و نیز استفتائات جدید، دستخوش تحولات متعددی گردیده است. ازآنجاکه مقررات جدید در مواردی فاقد سابقه تقنینی بوده، طبیعتاً نیازمند تدقیق و مطالعه از حیث تأثیر بر نظام حقوق کیفری است تا علاوه بر کشف ابعاد تحولات جدید، ابهامات و نواقص موجود در مواد قانونی جدید نیز کشف گردیده و در اصلاحات آتی قانون موردتوجه قرار گیرد. در این پژوهش کوشیده شده است تا با تحلیل مبانی مواد قانون مجازات مصوب سال 1370 و مواد قانون مجازات مصوب سال 1392 در زمینه دیات، رویکرد فقهی و حقوقی قانونگذار مورد استنباط و ارزیابی قرار گیرد. به نظر می‌رسد قانون‌گذار از تمرکز ویژه بر فتاوی امام خمینی(ره) در قانون مصوب 1370 به‌سوی ترکیبی از فتاوی ایشان، فتاوی مشهور و نیز فتاوی مقام معظم رهبری متمایل گردیده است. برخی از تغییرات نیز با انگیزه‌ گرهگشایی از مشکلات قضایی پیشین روی داده و برخی دیگر نیز به‌تبع ایرادات فقهی شورای نگهبان به لایحه قانون مجازات اسلامی صورت گرفته است. https://leg.isu.ac.ir/article_2650_d8bf84be3800d12f74d8b05e9b89836f.pdf
