Some of the basics are from western origins and some others are from Islamic sources. The foundations named "danger" and "fault" Retrieved from the West and the basis "negation of loss" or ability to attribute customary the loss can be deduced by the Islamic principles. Islamic Republic of Iran’s statutes in the course of their evolution, in each case has selected one of the foundations for civil liability that cause confusion for the lawyers. According to studies in Iranian law, it can be said that in spite of the richness of jurisprudence in the field of civil liability, the laws in this field is widely distributed in Iranian law. Civil Code Considering jurisprudential norms and mentioning some of the article in general, expresses the principles of civil liability; civil liability code based on theory of fault does not match to other rules; the previous and new Islamic penal codes suggest examples of Guarantee. Generally, it can be said, apart from civil liability code, other statutes are close together and derived from rich Islamic jurisprudence. The basis of destruction and causality is wide and absolute which shia jurisprudence confirms. This research which prepared in library, has a new sight of usual basis of civil liability. مبنای مسئولیت مدنی همواره از موضوعات بحث برانگیز در مسئولیت مدنی بوده است. ریشه برخی از این مبانی منابع غربی و ریشه برخی دیگر منابع اسلامی است. مبنای «خطر» و «تقصیر» برگرفته از غرب و مبنای «نفی ضرر» یا به عبارتی قابلیت انتساب عرفی ضرر به شخص از مبانی اسلامی قابل استنباط است. قوانین موضوعه جمهوری اسلامی ایران در سیر تطور خود، حسب مورد یکی از این مبانی را برای مسئولیت مدنی برگزیده است که موجب سردرگمی حقوقدانان شده است. براساس مطالعات انجام شده در حقوق ایران، می‌توان گفت به رغم غنای فقهی در زمینه مسئولیت مدنی، قوانین موجود در این زمینه در حقوق ایران بسیار پراکنده است. قانون مدنی با درنظر گرفتن موازین فقهی و با ذکر چند ماده به صورت کلی، اصول مسئولیت مدنی را بیان کرده است و قانون مسئولیت مدنی براساس نظریه تقصیر تنظیم شده و با سایر قوانین مطابقت ندارد. به صورت کلی می‌توان گفت، جدای از قانون مسئولیت مدنی، سایر قوانین موضوعه دارای رویه نزدیک به هم و برگرفته از فقه غنی اسلامی است و مبنای اتلاف و تسبیب می‌تواند به‌عنوان یک مبنای جامع و کامل ارائه گردد که فقه امامیه نیز موید آن است. در این پژوهش که به شیوه کتابخانه‌ای انجام شده است، مبانی رایج مسئولیت مدنی از زاویه‌ای دیگر نقد و بررسی شده است. https://leg.isu.ac.ir/article_2644_f35a2bc72dfdc2aae569a0c7370bd7f5.pdf
