For example, regarding the life of the Wise, some people know it as inherent argument and regards being loyal to it as a religious duty and others regards it as minor part of legislator›s confirmation. The modern principalists Islamic jurists have taken long steps to develop managerial Islamic jurisprudence of the society. Discussing the issues of “the development of topics” and “edicts issued by the highest authority in the land” and “Leisure zone” and “the separation of transactions and acts of worship”, Imam Khomeini and Shahid Sadr are prescribing the possibility of the use of wisdom and common law. Proving the possibility and desirability of the use of wisdom and common law in Islamic Jurisprudence and in legal analysis, the adjustment power and the Islamic Jurisprudence and law management of Shiite have been approved more for different societies and ages. اصولیون شیعه برخلاف اخباریون و فقهای اهل تسنن رویکرد معتدلی در استفاده‌ی توامان عقل، نقل و عرف برگزیده‌اند و با تکیه بر آن به مدیریت فقهی اعتقاد دارند، هرچند در مورد میزان و دلیل اعتبار آن اختلافاتی وجود دارد؛ مثلا در موضوع سیره‌ی عقلا برخی آن را دارای حجیت ‌ذاتی دانسته و ‌پایبندی به آن را واجب می‌دانند و برخی دیگر آن را فرع بر تایید شارع می‌دانند. فقهای ‌اصولی ‌کنونی قدم‌های بلندی در رشد فقه‌ مدیریتی جامعه برداشته‌اند. امام ‌خمینی‌(ره) با طرح مباحث «تحول موضوعات» و «احکام حکومتی» و شهید ‌صدر(ره) علیه نیز با طرح موضوع «منطقه الفراغ» و «تفکیک معاملات ‌و‌ عبادات»، امکان استفاده از عقل و عرف را در مواردی تجویز می‌کنند. با اثبات امکان و مطلوبیت استفاده از عقل و عرف در فقه و به تبع در تحلیل‌های حقوقی، قدرت تطابق و مدیریت فقه و حقوق شیعه برای جوامع و زمان‌های مختلف بیشتر اثبات می‌گردد. https://leg.isu.ac.ir/article_2604_880610aa9f9de9ea7c545169c716f477.pdf
