Hence, it has a long history in different countries and less is undergoing major changes as the main body of private law. Study of the formation and evolution of countries’ civil code helps to use their legislative experience and understand the strengths and weaknesses of the domestic law. Among Islamic countries, the Legislative Movement in the scope of civil law firstly commenced in Arabic countries. Hence, this article examines the emergence and evolution of civil law of Arabic countries, its origins, and characteristics. Then, by referring to the two major currents in the movement of civil legislation in the Arab world, the general orientations of each one are investigated and outlook of civil legislation in the light of Islamic law as a main source and along with the time requirements is drawn. قانون مدنی هر کشور، اساسی‏ترین قواعد حاکم بر روابط خصوصی اشخاص را در جامعه بیان می‌کند و در عمل سایر شاخه‌های حقوق را نیز تحت تأثیر قرار می‌دهد؛ به همین علت، در کشورهای مختلف معمولاً قدمت زیادی دارد و به عنوان پیکره اصلی حقوق خصوصی، کمتر دستخوش تغییرات عمده می‌شود. مطالعه سیر شکل گیری و تطور قانون مدنی کشورها  کمک شایانی  به استفاده از تجربه تقنینی آنان و شناخت نقاط قوت و ضعف حقوق داخلی می‏کند. در میان کشورهای اسلامی، جنبش قانون گذاری در حوزه حقوق مدنی ابتدا در کشورهای عربی آغاز شد. از این رو نوشتار حاضر به چگونگی پیدایش و سیر تطور قانون مدنی کشورهای عربی، مبادی و خصایص آنها می‏پردازد؛ آن‏گاه با اشاره به دو جریان اساسی نهضت قانون گذاری مدنی در جهان عرب، جهت گیری های کلی هریک بررسی و افق آینده تقنین مدنی در پرتو فقه اسلامی به عنوان منبعی اساسی و همگام با مقتضیات عصر ترسیم شده است. https://leg.isu.ac.ir/article_2457_7e05d6f828574fbc975a896b25bb011e.pdf
